These Website Terms of Use (“Website Terms”) govern your access to and use of the Sigmix websites at sigmix.ai and sigmix.sa (and any partner/white-label sites operated on the Sigmix platform), the Sigmix applications, and the services made available through them (together, the “Services”).
By accessing or using the Services, you agree to these Website Terms, the Sales & Subscription Terms, the Acceptable Use Policy, the Privacy Policy, and the Cookie Policy, which together form the agreement between you and us. If you do not agree, do not use the Services.

How these documents fit together
- These Website Terms govern your general use of the websites and platform, including browsing, account creation, and use of free and public features.
- The Sales & Subscription Terms govern paid plans, credits, top-ups, billing, and renewals.
- The Acceptable Use Policy governs what you may and may not do with the Services and the modules.
- The Privacy Policy and Cookie Policy govern how we handle personal data and cookies.
Where you sign a separate enterprise agreement with us, that agreement governs your paid use and prevails over these documents to the extent of any conflict. If there is a conflict between these Website Terms and the Sales Terms or AUP on a matter those documents specifically address, the more specific document prevails on that matter.
Eligibility and accounts
- You must be at least 18 years old and able to form a binding contract. The Services are intended for business and professional use.
- You must provide accurate registration information and keep it current.
- You are responsible for your account, your credentials, and all activity under your account. You must keep credentials confidential and notify us promptly at contact@sigmix.sa of any unauthorised use.
- One identity, many workspaces. A single user identity (one email) may be associated with multiple company workspaces. You are responsible for acting only within workspaces you are authorised to access.
- Authentication. We may require strong authentication (such as one-time passwords or multi-factor authentication), particularly for login, billing changes, or higher-risk actions. You are responsible for securing the device and account used to receive authentication codes.
- We may suspend or close accounts as set out in these Website Terms, the AUP, or the Sales Terms.
Signup status
Access to the Services may be limited (including during private or invitation-only launch phases). We may open, restrict, or close registration at our discretion.
Your content and your data
- You own your content. You retain all rights you hold in the content, prompts, files, data, and materials you submit to or generate through the Services (“your content”). We do not claim ownership of your content.
- Licence to operate the Services. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, process, transmit, display, and adapt your content solely to provide, secure, maintain, and support the Services for you, and to comply with law. This licence ends when your content is deleted, except for residual copies retained as required by law or in routine backups for a limited period.
- No training. We do not use your content to train our own or third parties' AI models. AI processing is performed for inference only, to deliver the output you request. (See the Privacy Policy for sub-processor detail.)
- Aggregated/de-identified data. We may generate and use aggregated and de-identified statistics that do not identify you or any individual to operate, secure, and improve the Services.
- Your responsibility for your content. You are responsible for your content and for having the rights and lawful basis to submit and use it, including any third-party personal data, as set out in the AUP and the DPA.
AI outputs
Outputs generated through the Services are made available to you for your business use, subject to these Website Terms and the AUP. Outputs are provided without warranty; they may be inaccurate or infringe third-party rights if misused, similar outputs may be generated for other users, and purely AI-generated material may not be protectable under KSA copyright law. Your responsibilities for reviewing, verifying, and lawfully using outputs are set out in the AUP.
Our intellectual property
The Services, the Sigmix platform, software, models, user interfaces, designs, text, graphics, logos, and trademarks (excluding your content and third-party materials) are owned by Sigmix or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for your internal business purposes during your subscription, subject to these documents. You must not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works of the Services except as permitted by law, and you must not use our names, logos, or branding without our written permission.
Third-party services, links, and providers
The Services rely on and may link to third-party providers and platforms (for example, payment, hosting, messaging, AI inference, and analytics providers). Third-party sites and services are governed by their own terms and privacy policies; we are not responsible for them. Where you use a feature that depends on a third-party platform (such as WhatsApp), you must also comply with that platform's terms, which flow down to you.
Beta and experimental features
We may offer features identified as beta, preview, or experimental. These are provided “as is,” may change or be withdrawn, may be less reliable, and are excluded from any service commitments.
Service availability and changes
We may modify, suspend, or discontinue any part of the Services, and may change these Website Terms or the features offered. The Services are provided on an “as is” and “as available” basis; we do not warrant uninterrupted, secure, or error-free operation, and we are not liable for unavailability beyond our reasonable control. Any service-level commitment applies only where expressly agreed in a signed enterprise agreement.
Suspension and termination
We may suspend or terminate your access where you breach these Website Terms, the AUP, or the Sales Terms; for non-payment; where we reasonably suspect fraud, illegality, or security or legal risk; or as required by law or a regulator. Where practical we give notice; for serious risk we may act immediately. You may stop using the Services at any time and may cancel paid subscriptions as set out in the Sales Terms. Provisions that by their nature should survive termination (including IP, disclaimers, liability, indemnity, governing law, and accrued payment obligations) survive.
Disclaimers
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, and availability. We do not warrant that the Services or any output will meet your requirements or produce any particular result. Informational outputs (including market intelligence and competitor intelligence) are for general information only and are not professional advice; service-specific disclaimers in the AUP apply.
Limitation of liability
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Services or these Website Terms shall not exceed the total fees you paid to Sigmix in the three (3) months immediately preceding the event giving rise to the claim (and where you have paid nothing, our aggregate liability shall not exceed SAR 1,000).
We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business, or for decisions made in reliance on the Services or outputs.
Carve-outs. Nothing limits liability for fraud or intentional misconduct, gross negligence, death or personal injury caused by negligence, or any liability that cannot be excluded under KSA law (including mandatory consumer protections).
Indemnity
To the maximum extent permitted by law, you will indemnify and hold harmless Sigmix and its affiliates, officers, and staff from claims, damages, losses, liabilities, and reasonable costs (including legal fees) arising from: your use of the Services or outputs; your content or prompts; your messaging, campaigns, or published content; your breach of these Website Terms, the AUP, or applicable law; or third-party claims relating to any of the foregoing. (This mirrors and supplements the indemnities in the AUP.)
Changes to these Website Terms
We may update these Website Terms. For material changes we will give notice by email, in-product notice, or website posting, and (where required) seek re-acceptance. Continued use after the effective date is acceptance. We keep version history.
Governing law and disputes
These Website Terms are governed by the laws of the Kingdom of Saudi Arabia. Disputes are resolved as set out in the Sales Terms: competent Saudi courts for consumers (with Ministry of Commerce consumer-complaint channels available); and SCCA arbitration, seated in Riyadh, in Arabic, before a single arbitrator, for business customers.
General
- Entire agreement. These Website Terms with the Sales Terms, AUP, Privacy Policy, Cookie Policy, and any applicable order form or enterprise agreement are the entire agreement between us.
- Severability. If any provision is unenforceable, the rest remains in effect.
- No waiver. Failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Website Terms without our consent; we may assign to an affiliate or in connection with a reorganisation or sale.
- No partnership. Nothing creates a partnership, agency, or employment relationship.
- Notices. We may give notice by email, in-product, or website posting; you contact us at the addresses above.
Language
These Website Terms may be provided in English and Arabic. In case of any conflict, the Arabic version prevails.
